Terms of Use

These terms are the agreement between you and MT App Studio for the Clearly iPhone app (com.mtappstudio.clearly). Installing or using the app means you accept them. If you do not, delete the app.

What you may do with the app

You get a personal, non-transferable licence to use Clearly on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not sell, rent, or redistribute the app; copy or republish its written content as your own; reverse-engineer or tamper with it; or use it to break the law.

Who owns what

The app, its name, its design, and the written content inside it belong to MT App Studio. Anything you write in the app is yours — and since it never leaves your device, we claim no rights over it and could not use it if we wanted to.

This is not medical or psychological advice

Clearly is a personal wellbeing app, not a medical device, and it is not a substitute for professional care. It does not diagnose or treat anything, and nothing in it should be used in place of advice from a doctor or a qualified mental health professional.

If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line now. An app cannot help with that, and this one will not pretend to.

Price

Clearly has no subscription and no in-app purchases today. If that ever changes, existing features will not be taken away from a version you have already installed, and these terms will be updated before anything is sold.

Your data is your responsibility

Everything the app records lives on your iPhone. There is no server-side backup, so deleting the app, losing the device, or resetting it removes your history for good. Include the app in your device backups if that history matters to you.

Changes and availability

The app is provided as it is today. Features may be added, changed, or removed in later versions, and we may stop distributing it. Nothing here promises the app will be available or functioning at any particular time.

No warranty, and the limit of our liability

Clearly is provided “as is”, without warranties of any kind, to the fullest extent the law allows. We do not warrant that it will be uninterrupted or error-free, or that using it will produce any particular result.

To the extent permitted by law, MT App Studio is not liable for indirect, incidental, or consequential losses, or for lost data. Where liability cannot be excluded, it is limited to the greater of the amount you paid for the app in the twelve months before the claim, or US$50. Some jurisdictions do not allow these limits, in which case they apply only as far as they legally can.

Apple’s role

This agreement is between you and MT App Studio only, not with Apple. Apple has no obligation to provide support or maintenance for Clearly. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; beyond that, Apple has no warranty obligation whatsoever with respect to the app. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory compliance, or consumer protection claims, and is not responsible for investigating or defending third-party intellectual property claims. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If something goes wrong

Email support.clearly@mtappstudio.com before doing anything formal, and say what happened and what you want. Almost everything can be settled that way, and we will reply within 30 days. Nothing in this paragraph stops you from going to a court or a consumer body if you would rather.

Your local law applies to you

Some countries give consumers rights that cannot be signed away. Nothing here affects those rights: where anything in these terms conflicts with them, your rights win. That includes the warranty and liability sections above.
